General terms & conditions of business
Registration:
Contracts can be concluded in writing, by telephone, electronically, or in person with the organizer (element3 OG). By registering, the customer acknowledges these general terms and conditions as an integral part of the contract between them and the organizer. The organizer may enter into subcontracts with partners and third-party providers for the implementation of the event.
Conditions of participation:
Good health is a prerequisite for all events. The customer agrees to inform the organizer of any health problems of the participants. Participation in an event under the influence of drugs, alcohol, psychotropic medication, or similar is permitted only at the participant’s own risk. Both the customer and all participants are obliged to adhere to the conditions of participation and to strictly follow the instructions of the organizer, trainers, and support staff. If these conditions are not met or the instructions are not followed, the organizer reserves the right to exclude participants from the activity. In case of exclusion, the cancellation policy applies; exclusion is equivalent to a no-show.
Liability:
Participation in incentive programs, team events, events, outdoor activities, and seminars is voluntary and at the customer’s own risk. The organizer also brokers products and services from other activity providers on behalf of the customer. No liability can be assumed for contractual fulfillment, accidents, delays, losses, or other irregularities arising from this brokerage activity. If the organizer delegates execution to a third party, the organizer shall not be liable for their actions or omissions. If the instructions of the organizer or their assistants are not followed, the organizer shall be exempt from all liability. The organizer’s liability for any damages resulting from slight negligence and for financial losses is excluded.
Image and video recordings during the event:
By participating in our events, guests acknowledge and agree that we may, for the purposes of documentation and public reporting, make image and sound recordings (particularly in the form of photos and videos) of the event and its participants by photographers commissioned by us. These recordings may be digitally stored and processed and published in a variety of media (e.g., print media, offers, websites, social media). Image and sound recordings are generally stored for up to three years; in individual cases, recordings may be retained for longer for archiving and documentation purposes. You have the right to revoke this consent at any time, without affecting the legality of the processing carried out on the basis of the consent up to the time of revocation.
You also have the right to information, rectification, erasure, objection, data portability, and to lodge a complaint with the data protection authority. Responsible for data processing: element3 OG, Sonngrub 68b, 6370 Kitzbühel.
Payment terms:
A deposit of half the event cost is due upon booking. The remaining amount is due without deduction within 14 days of receipt of the invoice.
Cancellation fees:
– 30% of the total amount from the date of booking
– 50% of the total amount between 60 and 30 days before the event
– 75% of the total amount between 29 and 14 days before the event
– 100% for later cancellation or no-show
Withdrawal by the Organizer – Program Changes:
Should the planned program not be feasible due to unforeseeable circumstances (force majeure, weather and natural conditions, official measures, or security risks), the Organizer reserves the right to adapt it accordingly or to offer an alternative program.
Place of Jurisdiction:
For all disputes arising from this contract, the Kitzbühel District Court shall have local and subject-matter jurisdiction.
